STATEMENT OF PERSONALLY IDENTIFIABLE INFORMATION PROCESSING
The Ghana Maritime Authority (GMA) is committed to the protection of individuals’ rights and privacy
and deems the lawful and proper treatment of personal data as important to its operations.
To this end, the GMA takes particular care when handling sensitive Personally Identifiable
Information (PII) entrusted to it by stakeholders who use its services.
The need for GMA’s processing of personal data such as the collection, recording, use, storage,
transfer and disposal of PII is to fulfil certain requirements of the Ghana Shipping Act, 2003 (Act
645) and the Ghana Shipping (Standards of Training, Certification, and Watchkeeping for Seafarers)
Regulation, 2016 (LI 2229).
The processing of PII to carry out GMA’s functions as outlined above includes among others the
following:
- Undertake and administer Seafarer Training, Certification and Examination;
- Regulate the engagement and welfare of Seafarers;
- Meet its legal obligations to the maritime community and the government of Ghana;
For these functions, the GMA is acting as a Government department.
In compliance with the Ghana Data Protection Act, 2012 (Act 843) the following principles have been
adopted to govern the collection, processing and transmission of PII:
- PII shall not be collected or processed unless the Data Subject has provided valid, informed
consent.
- PII shall be obtained only for specified, explicit, lawful, and legitimate purposes, and shall
not be further processed in any manner incompatible with those purposes.
- PII shall not be kept in a form which permits identification of the Data Subject for longer than
necessary for the permitted purposes.
- PII may be transferred where any of the following apply:
- The Data Subject has given consent to the proposed transfer;
- The transfer is necessary for the performance of a contract between the Data Subject and the
GMA, or the implementation of pre-contractual measures taken in response to the Data
Subject’s request;
- The transfer is necessary for the conclusion or performance of a contract concluded in the
interest of the Data Subject between the GMA and a Third Party; or
- The transfer is necessary or legally required on important public interest grounds, or for
the establishment, exercise, or defense of legal claims; or the transfer is required by law.
CONSENT NOTICE:
By booking an appointment you will be required to submit the requisite documentation to the Ghana
Maritime Authority for processing and/or submit yourself for biometric data capture. You are hereby
put on notice that by submitting the booking request for any of the services of the Ghana Maritime
Authority, you are providing informed consent to the processing of your Personally Identifiable
Information.
